Public Notices

 

Under the Corps' Regulatory Program, a public notice is the primary method for advising all interested parties of a proposed activity for which a permit is sought.  Public notices are also published to inform the public about new or proposed regulations, policies, guidance or permit procedures.

Public Notices published by the South Pacific Division (SPD) under the Regulatory Program are posted on this page. SPD public notices are primarily published to inform the public about new or proposed guidance, templates, procedures, and regional general permits, which are applicable to more than one of SPD's subordinate districts.  Once a public notice is available on-line, notification of the SPD Public Notice is sent to individuals on the mailing lists of the appropriate districts by each of the affected districts .

Updated BEI and CE Templates - 9/28/2015: The U.S. Army Corps of Engineers’ (USACE) South Pacific Division, including its Sacramento, San Francisco, and Los Angeles Districts, along with the U.S. Fish and Wildlife Service (USFWS), the California Department of Fish and Wildlife (CDFW), the California Natural Resources Agency (CNRA), the National Marine Fisheries Service (NMFS), the United States Environmental Protection Agency (EPA), the State Water Resources Control Board (State Water Board), and the Natural Resources Conservation Service (NRCS), as potential participants in Interagency Review Teams (IRT), have updated the standard Bank Enabling Instrument (BEI) template and the Conservation Easement (CE) template for use in the development of mitigation banks that are within, or that propose service areas within the State of California. This notice is to inform interested parties of the availability of the draft updated templates and to solicit comments from interested parties. SPN-2009-00443 - 9/11/2015: The U.S. Army Corps of Engineers, South Pacific Division (Corps) has posted Public Notice SPN-2009-00443 to www.spk.usace.army.mil/Media/RegulatoryPublicNotices.aspx and http://www.spd.usace.army.mil/Missions/Regulatory/PublicNoticesandReferences.aspx. The Corps is evaluating a permit application submitted by Panoche Valley Solar, LLC., for the discharge of fill material into 0.121 acre of waters of the U.S. for the construction of a 246 MW solar facility. This notice is to inform interested parties of: the publishing of the Draft Environmental Impact Statement for the proposed project, the location, date and time of the public meetings, and to solicit comments on the proposed project. The proposed project site is located approximately 0.75 miles north of Panoche Road, east and west of Little Panoche Road, Latitude 36.63149° North, Longitude 120.86622° West, in San Benito County, California. Written comments and/or a request for a paper copy of the notice may be submitted to regulatory permit specialist Lisa Gibson at 1325 J Street, Room 1350, Sacramento, California 95814, email Lisa.M.Gibson2@usace.army.mil, or telephone 916-557-5288. Comments must be received by October 26, 2015.

CLEAN WATER ACT INTERPRETIVE RULE FOR 404(f)(1)(A) - 2/2/2015: The U.S. Environmental Protection Agency (EPA) and the U.S. Department of the Army (Army) are announcing the withdrawal of an interpretive rule addressing the exemption from permitting provided under section 404(f)(1)(A) of the Clean Water Act (CWA). The agencies want to make clear that the statutory exemption of 404(f)(1)(A) still remains available for use when applicable for discharges of dredged and/or fill material associated with normal farming, silviculture, and ranching activities that are part of an established operation and that do not have as their purpose bringing an area of waters of the U.S. into a use to which it was not previously subject, where the flow or circulation of the waters of the U.S. may be impaired or the reach of such waters be reduced (see 33 CFR 323.4 for more information).
