Public Notices


Under the Corps' Regulatory Program, a public notice is the primary method for advising all interested parties of a proposed activity for which a permit is sought.  Public notices are also published to inform the public about new or proposed regulations, policies, guidance or permit procedures.

Public Notices published by the South Pacific Division (SPD) under the Regulatory Program are posted on this page. SPD public notices are primarily published to inform the public about new or proposed guidance, templates, procedures, and regional general permits, which are applicable to more than one of SPD's subordinate districts.  Once a public notice is available on-line, notification of the SPD Public Notice is sent to individuals on the mailing lists of the appropriate districts by each of the affected districts .

INTRODUCTION: This informational public notice announces updates to a procedure for determining compensatory mitigation requirements as required for processing of Department of the Army (DA) permits under section 404 of the Clean Water Act, section 10 of the Rivers and Harbors Act, and section 103 of the Marine Protection, Research, and Sanctuaries Act.

 ANNOUNCING:  Several corrections, enhancements, and clarifications have been made to this Corps Quality Management System (QMS) procedure:

 1)    12501-SPD.01 (checklist in Word format), .02 (instructions), .03 (examples), .05 (training presentation) and .06 (checklist in Excel format): Step 2 of checklist modified and additional step added to update how ratios for preservation are determined.

 2)    12501-SPD.03 (examples): Step 2 adjustment in example 7 changed from -3 to -2 to match instructions, following calculations also corrected. Added 5 new examples for preservation. All examples converted to Excel format.

 3)    12501-SPD.06 (checklist in Excel format): corrected equation in “required mitigation” cells. Also revised “final ratio” cells to ensure the resulting ratio always has a denominator of 1, even if negative adjustments are made.
